Online Divorce Pre-Qualification

Online Divorce Pre-Qualification

We understand that navigating divorce can feel overwhelming, especially when you’re not sure if you meet the legal requirements to proceed online. That’s why we’ve developed a user-friendly Initial Qualification Questionnaire available right on our homepage—designed to help you quickly and confidently determine whether you qualify to use our Florida Divorce Online services.
Alert
This process is completely free, and you won’t be asked to pay anything to complete it.
For couples in Florida who have agreed on the terms of their separation and want to avoid the stress, delay, and high cost of a courtroom divorce, our Florida Divorce Online service offers a reliable and user-friendly alternative. Whether you’re handling the process on your own or working cooperatively with your spouse, our platform is designed to make divorce as smooth and accessible as possible — from eligibility screening all the way to filing in court.

Pre-Qualification: Making sure you are eligible

Before you begin the divorce process, Florida law requires that certain conditions be met in order for your case to be filed and approved. To help with this, we start by offering a free pre-qualification questionnaire that you can access by clicking the red See if you qualify button on our homepage.
Once you do, you’ll be redirected to a brief, Florida-specific form where we ask a few simple questions. These include whether you or your spouse have lived in Florida (or been stationed there as part of military service) for at least six months. You’ll also be asked whether you know where your spouse currently lives, if you’ve both agreed on all aspects of your divorce (such as property division and child-related matters, if applicable), and whether your spouse is willing to sign the divorce paperwork. These questions help confirm that your case qualifies as an uncontested divorce — the fastest and most straightforward kind under Florida law.

If your answers confirm that you meet all requirements, the system will display a confirmation message, assign you a Divorce Case ID, and guide you to the next step in the process.

Filling out the full divorce questionnaire

Once you’ve qualified, you’ll begin our full online intake process. This is where you provide all the information necessary for us to draft your official divorce paperwork. The questionnaire is completed entirely online, and you can access it from your phone, tablet, or computer. You’ll be able to save your progress and return whenever you like — there’s no time limit.

The form includes up to 210 questions, but don't worry — not all of them will apply to your situation. The system adapts in real time based on your answers, meaning you only see the questions that are relevant to your case. The questions are grouped into clear, logical sections covering personal details, property and debts, child custody and support, spousal support (if relevant), and more.

Everything is written in plain language, with helpful explanations and tooltips to guide you along the way. There’s no need for legal experience — the questionnaire is designed to be as intuitive and accessible as possible.

Drafting your divorce documents

After you complete the questionnaire, our team will carefully review your responses to ensure consistency and accuracy. Then, we prepare a full set of divorce documents tailored to your situation and fully compliant with Florida court standards. These documents include everything required for your specific type of divorce — whether or not you have children, shared property, or financial complexities.
Some of the core documents we typically prepare are the Petition for Dissolution of Marriage and the Marital Settlement Agreement, which outlines how your property, debts, and responsibilities will be divided. If children are involved, we’ll also include a Parenting Plan, Child Support Worksheet, and a UCCJEA affidavit, which establishes jurisdiction over custody matters. Other supporting documents — such as Social Security affidavits, financial waivers, and answers or consents from your spouse — are also included as needed.

Once prepared, you’ll be notified and given the chance to review your documents before moving forward to the next step.

Signing & Notarizing the required forms

After reviewing your documents, it’s time to sign and notarize. Certain documents must be notarized to be accepted by Florida courts, and our system provides detailed instructions on which ones apply in your case. This step can often be completed online using a secure remote notarization service, eliminating the need for in-person appointments.

Typically, documents like the Petition for Divorce and Social Security affidavits are signed and notarized by the filing spouse. The Marital Settlement Agreement and Parenting Plan, if applicable, must be signed and notarized by both parties. Waivers of Financial Disclosure and UCCJEA affidavits also require notarization, while other documents — such as the Child Support Worksheet — simply require a signature.
Idea
To make things easier, each document will be clearly labeled with instructions, so you’ll never be unsure of what to do next.

Filing with the Florida court

Once all documents are signed and notarized, you’re ready to file. You can choose to file them on your own, following our step-by-step filing instructions customized to your county, or opt to use our Filing Assistance service, where we handle the process for you.

Filing is done with the Clerk of Court in your local jurisdiction. If all documents are complete and correct — and your case is uncontested — there may be no need to appear in court at all. In such cases, a judge will review your documents and issue a Final Judgment of Dissolution of Marriage.

The time it takes to finalize your divorce can vary depending on the county and court volume, but most uncontested divorces in Florida are completed within 21 to 30 days.

What If You Have Children?

Our platform fully supports divorces involving children. When filling out the full questionnaire, you’ll be asked to provide additional details such as the child’s full name, date of birth, address history for the past five years (as required by the UCCJEA), proposed custody arrangements, visitation schedules, and agreements regarding child support and medical care.

Based on your responses, we’ll prepare all of the documents necessary for court approval, including the Parenting Plan, UCCJEA Affidavit, and Child Support Worksheet. These documents help ensure the best interests of the child are addressed and that your agreement complies with Florida law.

Who can use Florida Online Divorce?
