What is an Uncontested Divorce?

An uncontested divorce is a legal process where both spouses agree on all aspects of their separation, including property division, child custody, and financial matters. This type of divorce is typically faster, less expensive, and less stressful than a contested divorce, as it avoids prolonged court battles. In uncontested divorces, there are absolutely no disagreements for a judge to resolve, which makes the process faster, less expensive, and often less emotionally stressful.

In the state of Florida uncontested divorces can be finalized without the need for a court trial.

To qualify, spouses must:
  • Agree to end the marriage

  • Resolve all issues without the court’s intervention

  • Meet any residency and documentation requirements in their state
